1.1 In this By-law, unless the context otherwise requires:
- “Agricultural Vehicle” means a self-propelled implement of husbandry as defined by the Highway Traffic Act, R.S.O. 1990, c. H.8;
- “Clerk” means the Clerk and his/or her designate of the Corporation;
- “Corporation" means the Corporation of the Town of Bradford West Gwillimbury;
- “Council” means the Council for the Corporation of the Town of Bradford West Gwillimbury;
- “Driver” means the person in care and control of a vehicle. Driver shall also include the owner of the vehicle, even though the owner may not be in care and control of the vehicle at the time of the contravention of the by-law;
- “Drive-through” means that portion of a commercial property that is designated as a drive-through on an approved site plan, and posted with appropriate signage as a drive-through;
- “Electric Vehicle” means a Vehicle powered only by a battery or batteries;
- “Idle” means the operation of a Vehicle engine while the Vehicle is not in motion and “idling” has a corresponding meaning;
- “Layover” means a stopping point along a transit route for a maximum of 10 minutes to allow transit vehicles to adjust service schedules;
- “Mobile Work Vehicle” means a Vehicle containing equipment that must be operated inside or in association with the Vehicle which includes but is not limited to garbage and snow removal Vehicles, or a Vehicle serving as a facility for taking measurements or making observations or conducting maintenance or construction;
- “Officer” includes a person appointed and is responsible for the enforcement of the provisions of this By-law and may include his/her designate and includes:
- Municipal Law Enforcement Officers appointed by the Corporation; and
- Police Officers appointed under the Police Services Act;
- “Park or parked” means the halting of a Vehicle, whether occupied or not, except when halted temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers;
- “Person” means an individual, firm, corporation, association or partnership;
- “Stop or stopped” means the halting of a Vehicle, even momentarily, whether occupied or not except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control sign or signal;
- “Stopover” means a scheduled delay for a maximum of 10 minutes at a transit Vehicle terminal to allow transit Vehicles to adjust to service schedules;
- “Town” means the Territorial Jurisdiction of the Town of Bradford West Gwillimbury;
- “Vehicle” or “Motor Vehicle” means an automobile, a motorcycle, a motor assisted bicycle unless otherwise indicated in this by-law, and any other vehicle propelled or driven otherwise than by muscular power, but does not include a street car or other motor vehicle running only upon rails, a traction engine, a farm tractor, or a self-propelled implement of husbandry.
