Notice of Decision to Grant Draft Approval for a Plan of Subdivision and Notice of Passing of a Zoning By-law Amendment

Decision of Council
Take Notice that the Council of The Corporation of the Town of Bradford West Gwillimbury approved application D14-21-05 respecting an amendment to Zoning By-law 2010-050, being By-law 2026-055, and approved application D12-21-09, respecting a draft plan of subdivision on the 16th day of June, 2026 under sections 34 and 51 of the Planning Act, R.S.O. 1990, c. P.13, for the property municipally addressed as 4140 County Road 88. A key map showing the location of the lands to which the by-law applies and draft plan is located in is attached.
The purpose of By-law 2026-055 is to rezone a portion of the subject property from the Future Development “FD” zone and Environmental Protection “EP” zone to the Residential One Exception Holding “R1-2*17(H1), R1-2*18(H1),” “R1-3*5(H1),” “R1-1*5(H1),” Zone, Open Space “OS” zone and the Environmental Protection “EP” zones in order to facilitate the development of 186 detached dwellings, a realigned Pennville Creek and parks and open space. The Holding (“H1”) symbol shall be removed once Council is satisfied with the applicable terms of a Subdivision Agreement have been complied with.
The Draft Plan of Subdivision consists of 186 lots for detached dwellings, one (1) block for a park, one (1) block for a creek corridor and one (1) block for future part lots, all to be located on future municipal roadways. The proposed Plan of Subdivision has been granted draft approval subject to the fulfillment of conditions.
In conformity with sections 34(18) and 51(22) of the Planning Act, comments/submissions and response to same are set out in Report No. PLN-2026-43 which is available for viewing on the municipal website at www.townofbwg.com/agenda or by contacting the Office of Community Planning at planninginfo@townofbwg.com.

Only those listed in 34(19) and 51(39) may appeal to the Ontario Land Tribunal (OLT) in respect of Council's decision, including Conditions and any lapsing provisions by filing a notice of appeal with the Clerk of The Corporation of the Town of Bradford West Gwillimbury either via the Ontario Land Tribunal e-file service (first-time users will need to register for a My Ontario Account) at https://olt.gov.on.ca/e-file-service/ by selecting Town of Bradford West Gwillimbury as the Approval Authority or by mail, which must be received no later than July, 19, 2026. NOTE: Notices may be dropped in the mail slot at 100 Dissette Street, Units 7 and 8, up to the deadline. The filing of an appeal after 4:30 p.m., in person or electronically, will be deemed to have been received the next business day. The appeal fee of $1,100 can be paid online through e-file or by certified cheque/money order to the Minister of Finance, Province of Ontario. If you wish to appeal to the Ontario Land Tribunal (OLT) or request a fee reduction for an appeal, forms are available from the OLT website at www.olt.gov.on.ca. Zoning By-laws (O.Reg 545/06)
No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
Plans of Subdivisions (O.Reg 544/06)
You will be entitled to receive notice of any changes to the conditions of approval of the proposed plan of subdivision if you have made a written request to be notified of changes to the conditions.
No person or public body shall be added as a party to the hearing of an appeal regarding any changes to the conditions of approval unless the person or public body, before the approval authority made its decision, made oral submissions at a public meeting, if one was held, or written submissions to the approval authority, or made a written request to be notified of the changes to the conditions or, in the Ontario Land Tribunal’s opinion, there are reasonable grounds to add the person or public body as a party.
No person or public body shall be added as a party to the hearing of the appeal of the decision of the approval authority, including the lapsing provisions or the conditions, unless the person or public body, before the decision of the approval authority, made oral submissions at a public meeting or written submissions to the council, or made a written request to be notified of changes to the conditions or, in the Ontario Land Tribunal’s opinion, there are reasonable grounds to add the person or public body as a party.
