Compliance Audit Committee
Municipal Elections Act, 1996 requires all municipalities and local boards to establish a Compliance Audit Committee before October 1 of an election year. For the 2018 Municipal Election, the Township of Adjala-Tosorontio, the Town of Bradford West Gwillimbury, the Township of Essa, the Town of Innisfil and the Town of New Tecumseth have established a joint committee known as the South Simcoe Joint Compliance Audit Committee.
The role of the joint committee is to review and consider compliance audit applications received by an elector who believes that a candidate or registered third party advertiser has contravened a provision of the Municipal Elections Act relating to election campaign finances.
The joint committee is also responsible for reviewing reports submitted by the Town Clerk with respect to any contributor who appears to have contravened any of the contribution limits to a candidate’s or registered third party’s election campaign.
The powers and functions of the compliance audit committee are in accordance with section 88.33 to 88.37 of the Municipal Elections Act and provides the authority to:
- consider an application for compliance audit and decide whether it should be granted or rejected;
- appoint an auditor, if the committee decides to grant a compliance audit;
- consider the auditor’s report and decide whether legal proceedings should be commenced against the candidate or registered third party for an apparent contravention; and
- receive and consider the report from the Town Clerk and decide whether to commence a legal proceeding against a contributor for an apparent contravention.
Compliance Audit Process
Any eligible elector who believes on reasonable grounds that a candidate or registered third party advertiser has contravened a provision of the Municipal Elections Act relating to election campaign finance may submit an application for a compliance audit.
All requests for a compliance audit must be made on the applicable form (see Documents at right) and submitted to the Town Clerk. The committee does not receive applications to audit school board trustee campaigns; those applications must be submitted to the secretary of the applicable school board. There is no fee for submitting an application.
Please note that the deadlines for filing compliance audit applications with respect to the 2018 Municipal Election have passed.
Applications for a compliance audit for the Ward 2 By-election must be submitted to the Town Clerk by: May 19, 2021.
