Notice of the Passing of a Zoning By-Law
Pursuant to Section 34(18) of the Planning Act, R.S.O. 1990, c. P.13, as amended
Take notice that the Council of The Corporation of the Town of Bradford West Gwillimbury passed By-law 2021-57 amending Zoning By-law 2010-050 on the 7th day of September, 2021 under section 34 of the Planning Act, R.S.O. 1990, c. P.13, as amended, in respect of the lands municipally known as 2547 Line 6. A key map showing the location of the lands to which the by-law applies is attached.
The purpose of By-law 2021-57 is to rezone the lands from the Future Development “FD” and Environmental Protection “EP” Zones to the Residential Two Exception “R2-1*12” and Environmental Protection Exception “EP*4” Zones to facilitate the creation of a new residential building lot to enable the construction of a semi-detached dwelling and allow the existing accessory structure to remain in the “R2-1*12” Zone and recognizing the existing accessory structure and uses in the “EP*4” Zone. Any person or public body may appeal to the Ontario Land Tribunal in respect of Council’s decision by filing a notice of appeal with Rebecca Murphy, Clerk, of The Corporation of the Town of Bradford West Gwillimbury, 100 Dissette Street, P.O. Box 100, Bradford, Ontario, L3Z 2A7, which must be received no later than October 5, 2021. NOTE: Notices may be dropped in the mail slot at 100 Dissette Street, Units 7 and 8, up to the deadline. The notice of appeal must set out the reasons for the appeal and must be accompanied by the OLT form (available from the OLT website at https://olt.gov.on.ca) and fee of $1,100.00 payable to the Minister of Finance.
In conformity with section 34(18) of the Planning Act, public comments/submissions and response to same are set out in Report No. DES 2021 31 which is available for viewing on the municipal website at https://bit.ly/3E9SJG0 or by contacting the Office of Community Planning at email@example.com.
Only individuals, corporations, and public bodies may appeal a zoning by-law to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or group on its behalf.
No person or public body shall be added as a party to the hearing of the appeal unless, before the By-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the Council of the Town of Bradford West Gwillimbury or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
