​​Notice of the Passing of a Zoning By-Law

Pursuant to Section 34(18) of the Planning Act, R.S.O. 1990, c. P.13, as amended

TAKE NOTICE that the Council of The Corporation of the Town of Bradford West Gwillimbury passed By law 2020-100 amending Zoning By-law 2010-050 on the 3rd day of November, 2020 under sections 34 and 36 of the Planning Act, R.S.O. 1990, c. P.13, as amended, in respect of lands located in Part of Lot 1, Concession 7 and municipally known as 4240 County Road 88. A key map showing the location of the lands to which the by-law applies is attached.

map of subject propertyThe purpose of By-law 2020-100 is to rezone the subject lands from the Rural Settlement Commercial "C5" Zone to the Rural Settlement Commercial Exception Holding "C5*3(H1) Zone in order to permit a three-storey, mixed-use building, containing 1,349.76 square metres of commercial space on the ground floor and 30 residential units on the upper floors. The Holding "(H1)" symbol will be removed once the site plan agreement has been executed. Any person or public body may appeal to the Local Planning Appeal Tribunal in respect of Council's decision by filing a notice of appeal with Rebecca Murphy, Clerk, of The Corporation of the Town of Bradford West Gwillimbury, 100 Dissette Street, P.O. Box 100, Bradford, Ontario, L3Z 2A7, which must be received no later than December 2, 2020. The notice of appeal must set out the reasons for the appeal and must be accompanied by the LPAT form (available from the LPAT website at www.elto.gov.on.ca) and fee of $1,100.00 payable to the Minister of Finance.

In conformity with section 34(18) of the Planning Act, public comments/submissions and response to same are set out in Report No. DES 2020 32 which is available for viewing on the municipal website or by contacting the Office of Community Planning at planninginfo@townofbwg.com.

Only individuals, corporations, and public bodies may appeal a zoning by-law to the Local Planning Appeal Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or group on its behalf. 

No person or public body shall be added as a party to the hearing of the appeal unless, before the By-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the Council of the Town of Bradford West Gwillimbury or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
